We provide you with information in accordance with Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as “GDPR“).
For the purposes of this Policy:
“Project” means the project for the construction of a residential complex called MILLHAUS at the intersection of Plynárenská and Mlynské nivy Streets in Bratislava, as further described on the website www.millhaus.sk.
“Immocap” is the company Immocap, a.s., with its registered office at Plynárenská 7/C, 821 09 Bratislava, ID no: 35 944 536, registered in the Commercial Register of the Municipal Court Bratislava III, sec: Sa, insert no. 3633/B.
“Wood&Company” is Wood & Company, a.s., with registered office at Gorkého 4, 811 01 Bratislava, ID No: 35 827 092, registered in the Commercial Register of the Municipal Court Bratislava III, sec: Sa, insert no. 3093/B.

The legitimate interest pursued by this processing is our ability, if we so choose, to (i) secure external financing for the Project, whereby the financier may require the submission of documents for the sale/lease process of the apartments and premises, (ii) execute the sale of the entire Project to a third party, whereby the prospective purchaser may require documents for the purpose of conducting a legal due diligence prior to the transaction. In both cases, third parties will be contractually or legally bound to a duty of confidentiality with regard to the data provided. |

We respect your rights as a data subject when processing your personal data. Under applicable law, you have several rights as a data subject in relation to the processing of your personal data, depending on the lawful reason and purpose of the processing:
Recipients of your personal data include Immocap, Wood&Company, suppliers of services to our company and external consultants such as software system providers, IT service providers, mail and courier service providers, translators, accounting and tax advisors, legal advisors, marketing agencies.
Immocap and Wood&Company, as investors in a joint Project, each process your personal data as a separate controller, to the extent of identification data and history of concluded contracts and amendments, on the basis of the provisions of Article 6(1)(f) GDPR, for the purpose of internal record keeping and control of activities within the group of each investor. A legitimate interest is the ability of investors in the Project to collect, verify and analyse data for the purpose of evaluating the efficiency of the use of invested resources, the rate of return and improvement thereof, as well as the ability to require and implement measures to increase such efficiency and rate of return. Each of Immocap and Wood&Company will process the data for this purpose for as long as necessary to fulfil its legitimate interest, at the latest until the completion of the Project (i.e. the sale of all apartments in the Project) or until the exit from the Project as part of the sale of the entire Project or its interest in the Project to a third party.
Both Immocap and Wood&Company may also process your personal data as controllers on other legal bases and for other purposes. Your personal data may also be disclosed to courts and public authorities, where necessary, for the purpose of fulfilling our company’s legal obligations, enabling the exercise of control over our company’s activities, exercising the powers of a court or public authority, resolving disputes and enforcing judgments.
Your personal data may be disclosed to the acquirer if the personal data is transferred as part of a sale or other transfer of all or part of our company’s assets to the acquirer.
The persons concerned are customers and potential customers of our company, as well as contact persons of customers and potential customers of our company, if the customers are legal entities.
We most often obtain personal data directly from you as the data subject. In some cases, however, we must supplement the data provided from public sources (e.g. trade register, land registry, commercial gazette, etc.), or a third party may provide us with the data (e.g. if the business partner provides personal data of its representatives or other contact persons prior to the conclusion of the contract).
The maximum scope of personal data processed is as follows: academic title, first name, surname, maiden name, permanent address, correspondence address (if different from the permanent address), date of birth, birth number, marital status, nationality, ID card number or other identity document, bank connection and bank account number, email address, telephone number. This maximum scope of personal data processed relates to the purpose of the performance of the contract concluded between you and our company. In relation to other processing purposes, the scope of the data processed is limited to the data necessary for the purpose or only to the data for which you have given your consent, if you have given your consent.
Before entering into a contract with our company, the provision of your personal data is voluntary. If you enter into contract negotiations and subsequently enter into a contract with us regarding the Project, the requirement to provide your personal data arises from the relevant laws, i.e. without providing your data, it will not be possible to conclude a valid contract and subsequently fulfil the obligations arising from it, as well as the obligations arising from the law and related to the existence of the contract in question.
Your personal data is not exclusively processed in an automated manner, but is always processed by our trained staff.
We may also carry out profiling with your personal data, but only to the extent necessary to provide you with individually tailored offers and information and not to bother you with mass general offers and information.
In accordance with the requirements of applicable law, we have put in place, implement and maintain all necessary security, technical and organisational measures, internal controls and processes to protect your personal data, in accordance with best business practices appropriate to the potential risk to you as a data subject. We also take into account the state of technological development in order to protect your personal data against accidental loss, destruction, alteration, unauthorised disclosure or access.
These measures may include, but are not limited to, taking reasonable steps to ensure the accountability of relevant employees who have access to your data and training of employees.

I grant this consent for a period of 3 years from the date of its granting.

Consent is voluntary and is not my legal obligation. The granting of consent is not a condition for being able to enter into a contractual relationship with any of the aforementioned data controllers or a member of their group of companies, and the failure to grant consent shall have no effect on me other than that I will not be able to do so without the provision of personal data and consent to its processing, before entering into a contract with the data controller, to obtain the above information about its activities, as the data controller will not be able to use my contact details to send me sales and marketing information. I am also aware that without evaluating the additional information provided in the communication, the operator will not be able to ensure the addressability of the information provided and its conformity with my needs.
